Terms of Use

2) Eligibility

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use the App. If you are under 18, you must have consent from a parent or legal guardian.

3) Privacy

Our Privacy Policy explains how we handle information. In short: MoodNav does not collect personal data in-app; mood entries and settings stay on your device. If you email us at support@alteregogen.ai, we receive your email address and the message for support purposes. By using the App, you acknowledge our Privacy Policy.

4) License & Ownership

• License. Subject to these Terms and the Apple EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use one copy of the App on an Apple-branded device you own or control.
• Reservation of rights. We and our licensors retain all rights, title, and interest in and to the App, including all intellectual property rights. The App is licensed, not sold.
• Open-source notices. The App may include components under separate open-source licenses. Those licenses govern their components.

5) Acceptable Use

You agree not to, and not to allow others to:

• Use the App for any unlawful, harmful, abusive, harassing, or disruptive purpose.
• Reverse engineer, decompile, or attempt to access source code or underlying models except where allowed by applicable law.
• Interfere with or disrupt the App or related services, including by introducing malware or excessive automated traffic.
• Bypass or attempt to bypass security or usage controls.
• Use the App to create, train, or improve competing products in violation of these Terms or applicable law.

6) Wellness Only—No Medical Advice

• MoodNav is not a medical device. It is intended for general wellness, reflection, and self-management support only.
• The App does not diagnose, treat, cure, or prevent any disease or condition and is not a substitute for professional medical advice.
• If you are experiencing a medical or mental health emergency, call your local emergency number immediately.
• Consult a qualified professional before making changes to your health routines based on the App’s content.

7) Features, Ads, and Connectivity

• On-device first. MoodNav is designed so your entries and settings remain on your device. Optional on-device analysis runs locally.
• Ads. If the App shows ads (e.g., rewarded ads), they are configured to avoid sending personal data to us. Any limited processing required to deliver or measure an ad is handled by the ad provider under its policies and your device settings. We do not receive that information.
• Connectivity. Certain features may require an internet connection. You are responsible for carrier/data charges.

8) Subscriptions, Trials, and Billing

• MoodNav Plus. Premium features (if offered) are billed via Apple In-App Purchase (IAP). You can manage or cancel in your Apple ID Subscriptions settings.
• Auto-renewal. Subscriptions renew automatically until canceled. Your account is charged within 24 hours prior to the end of the current period.
• Trials. If a free trial is offered, unused portions may be forfeited when you purchase a subscription.
• Price changes. We may change pricing for future periods; Apple will notify you where required. Continued subscription after a change constitutes acceptance.
• Refunds. Refunds are provided by Apple under its policies. Contact Apple Support for billing issues.

9) User Content & Feedback

• Local content. Mood entries and settings are stored on your device. We do not host them.
• Support emails. If you voluntarily send us feedback or support requests, you grant us a non-exclusive, worldwide, royalty-free license to use that feedback to operate and improve the App. Do not send confidential or health records.

10) Third-Party Services

The App may reference or link to third-party services (e.g., App Store billing, ad providers). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services.

11) Changes; Suspension; Termination

• Changes to the App. We may add, change, or remove features at any time.
• Terms updates. We may update these Terms. The “Effective” date will change, and material updates may be highlighted in-app or on this page. Your continued use after changes means you accept the updated Terms.
• Suspension/Termination. We may suspend or terminate access if you breach these Terms or for risk, legal, or security reasons. You may stop using the App at any time; deleting the App will remove on-device data, subject to your iOS settings.

12) Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) FIFTY U.S. DOLLARS (US $50).

14) Indemnification

You agree to defend, indemnify, and hold harmless AlterEgoGen and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or misuse of the App.

15) Apple App Store Terms

• These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to furnish maintenance or support for the App.
• To the extent any warranty applies that cannot be disclaimed, Apple may refund the purchase price (if any) and, to the maximum extent permitted by law, will have no other warranty obligation.
• Apple is a third-party beneficiary of these Terms with respect to your App Store license and may enforce them against you.
• You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16) Governing Law; Venue

These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Connecticut for any dispute arising from these Terms or the App, except where applicable law provides otherwise.

17) Miscellaneous

• Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our prior written consent. We may assign them as part of a merger, acquisition, or sale of assets.
• Entire agreement. These Terms, together with the Apple EULA and our Privacy Policy, constitute the entire agreement between you and us regarding the App.
